1. What is WishYou?

WishYou is a digital platform created with a single, positive purpose: to help you remember the birthdays of the people you care about and to make it easy to send them wonderful birthday wishes.

To do this, our app acts like a smart calendar and address book combined. With your permission, we securely look at the contacts saved in your Google account. We then match you with people in your contacts who are also using WishYou (we call these "mutuals"). Once connected, we remind you when their birthdays are coming up, and we provide tools for you to write, generate, and send them special birthday messages.

2. Who Can Use This App? (Eligibility)

We want WishYou to be a safe place for everyone, but there are a few basic requirements you must meet to use our app:

• Age Requirement: You must be at least 13 years old to use this app. If the laws in your country require you to be older to use online services without a parent's permission, then you must meet that older age requirement.
• Ability to Agree: You must be legally able to agree to these rules. If you are reading this on behalf of a company or an organization, you are promising us that you have the authority to agree to these rules for that company.
• Good Standing: You cannot use this app if we have previously banned you or disabled your account for breaking our rules in the past.

4. Privacy and Your Information

We care deeply about your privacy. In order to provide our service, we need to handle your personal information and look at your address book to find your friends.

We have written a very detailed, separate document called our Privacy Policy that explains exactly what information we look at, how we scramble phone numbers so they cannot be read, and how we protect your data. By agreeing to these Terms of Service, you are also confirming that you have read and agreed to our Privacy Policy.

6. The Messages and Wishes You Send (Your Content)

When you write a beautiful birthday wish for your friend, that message belongs to you. We do not claim to own the words you write.

However, by typing a message into our app and pressing send, you are giving us the technical permission we need to take that message, store it temporarily in our systems, and deliver it to your friend's screen. You are also promising us that the messages you send do not violate anyone else's rights (for example, do not copy a famous poem and claim you wrote it yourself).

7. Our Property (What Belongs to Us)

While you own the messages you write, we own everything else about the WishYou app. The design of the app, the colors, the logos, the computer code that makes it work, the text we have written, and the name "WishYou" all belong exclusively to us. You are not allowed to copy our app, steal our logos, or try to sell our app as if it were your own invention.

8. Ending Our Relationship (Termination)

You are completely free to stop using WishYou at any time, for any reason. You can simply delete your account in the app settings and walk away.

On our side, we also have the right to end our relationship with you. We can suspend or completely permanently delete your account at any time, especially if we believe you have broken any of the rules listed in Section 5, or if you are doing something that harms the app or other users. If we delete your account for breaking the rules, you will lose access to all your connected friends and upcoming birthday reminders immediately.

9. Disclaimers: Things We Are Not Responsible For

We work very hard to make sure WishYou works perfectly every single day. However, technology can sometimes fail, and we need to be clear about what happens if things go wrong.

• The App is Provided "As Is": This means you are using the app in its current condition. We cannot absolutely guarantee that the app will be perfect, that it will never crash, or that it will be entirely free of tiny glitches.
• Missed Birthdays: Our primary job is to remind you of birthdays. However, if our system experiences a technical hiccup, or your internet goes down, or an email reminder gets lost in your spam folder, and you forget your best friend's birthday as a result, we are not responsible for the consequences. You cannot sue us or blame us for a ruined relationship or an angry friend because a reminder did not arrive on time. It is always a good idea to keep your own backups of the most important dates in your life!

10. Limitation of Liability

This section is very important legally. It means that there is a strict limit on how much we can be held responsible if something goes wrong while you are using the app. Under no circumstances will WishYou, or the people who built it, be legally or financially responsible to you for any indirect damages, accidental damages, or special losses. For example, if you claim that using our app somehow caused you to lose money, lose your reputation, or suffer emotional distress, we are not legally responsible for those claims. By using the app, you accept this risk.

11. Changes to These Rules

As our app grows and adds new features, we might need to change these rules. We have the right to update this document at any time. If we make a tiny change (like fixing a spelling mistake), we will just update the document. If we make a very big change that affects your rights or how you use the app, we will try our best to let you know ahead of time, usually by sending you an email or showing a big alert when you open the app. If you continue to use WishYou after the new rules have been posted, that means you have read the new rules and agree to follow them.
